<br /> § 36-2 SAN MARCOS RIVER CORRIDOR § 36-2 <br /> (3) The approved site plan shall be filed by the chief building <br /> official who shall issue building permits and certificates of <br /> occupancy only for development and construction that com- <br /> plies with the approved site plans and rendering. <br /> (4) All subdivisions within the SMRC, which are larger than <br /> two (2) acres, or which will contain nonresidential struc- <br /> tures that total five thousand (5,000) square feet, or more, <br /> or which will contain more than six (6) residential units <br /> shall be planned unit development (PUD) or planned de- <br /> velopment district (PDD) subdivisions and shall be zoned <br /> PDD or PUD. The required development plans for these <br /> subdivisions shall meet the requirements of the plans re- <br /> quired of the PDD [or] the PUD. <br /> (5) Approved PUD or PDD development plans for subdivisions <br /> outside the city limits shall be the basis for the future <br /> zoning districts of the SMRC or PUD or PDD subdivisions <br /> when these subdivisions are annexed. <br /> (D) This chapter sets out additional requirements for the sub- <br /> division and development of land located in the San Marcos River <br /> corridor. A person wishing to subdivide land in the corridor must <br /> comply with both these special requirements and with the appli- <br /> cable requirements of Appendix C, Subdivisions, of the City Code. <br /> In case of conflict between the requirements of this chapter and <br /> those of Appendix C, or of any other ordinance, the requirements <br /> of this chapter shall govern. <br /> (E) Exceptions. <br /> (1) The additional requirements of the San Marcos River cor- <br /> ridor ordinance [this chapter] shall not apply to develop- <br /> ment, redevelopment, repair, or construction. or reconstruc- <br /> tion of a single-family detached residence. on a properly <br /> platted subdivision lot that has been properly platted be- <br /> fore the effective date of this chapter. "Properly platted," <br /> as used herein, means that the lot as it exists in its present <br /> form, dimension, and metes and bounds has been approved <br /> by those bodies required by law to approve such plats and <br /> is legally recorded in the office of the county clerk. <br /> Supp. No. 23 1060.147 <br />
