<br /> § 36-2 SAN MARCOS CODE § 36-3 <br /> (2) Erodible soils. If a development is on land which has been <br /> included within the San Marcos River Corridor because it <br /> is shown on the Hays, Guadalupe or Caldwell County Soil <br /> Conservation Service soil survey maps as being on soils <br /> that have a high or severe water erosion hazard, is not <br /> within two hundred (200) feet of the bank of the San Mar- <br /> cos River, and is not within a floodplain within the SMRC, <br /> and a soils test, as verified by the director, shows that the <br /> development is not on soils that have a high or severe <br /> water erosion hazard, and that the storm water runoff <br /> from the development will not flow over soils that have a <br /> high or severe water erosion hazard, the development shall <br /> not be required to meet the additional requirements of this <br /> chapter. Definitions. <br /> The following words, terms and phrases, when used in this <br /> chapter, shall have the meanings ascribed to them in this sec- <br /> tion, except where the context clearly indicates a different meaning: <br /> Applicant: A person, business, corporation or entity applying <br /> for approval of development plans under this chapter for property <br /> within the boundaries of the San Marcos River corridor. <br /> Bank: The bank shall be defined as the area contiguous to the <br /> floodway as defined in Chapter 5 of the City Code where a con- <br /> tinuous slope of thirty-five (35) per cent or more ends and be- <br /> comes less steeply sloped or the edge of the average annual <br /> waterline of a watercourse, whichever is greater. The location of <br /> the bank shall be determined by the director based on this definition. <br /> Supp. No. 23 1060.148 <br />
