<br />is <br /> <br />unavailable <br /> <br />by <br /> <br />telephonic <br /> <br />communication <br /> <br />or <br /> <br />otherwise <br /> <br />to issue <br /> <br />instructions <br /> <br />necessary for the proper progress and acceptance of work; <br /> <br />(2 ) <br /> <br />when jeopardy to life and/or property exists; and/or (3) when lack <br /> <br />of <br /> <br />instructions <br /> <br />and/or <br /> <br />unavailability of Engineer will result in, in <br /> <br />Owner's <br /> <br />opinion, <br /> <br />harm <br /> <br />to <br /> <br />Owner, <br /> <br />in <br /> <br />which case instructions may be <br /> <br />forwarded <br /> <br />directly <br /> <br />have <br /> <br />authority <br /> <br />to <br /> <br />to the Contractor by Owner. The Engineer shall <br />act on behalf of the Owner only to the extent <br />in the construction contract documents unless <br /> <br />provided <br /> <br />herein <br /> <br />and <br /> <br />otherwise <br /> <br />modified <br /> <br />by <br /> <br />written <br /> <br />instrument in accordance with Section <br /> <br />1.3.15. <br /> <br />Any instructions issued directly by Owner to Contractor shall <br /> <br />be <br /> <br />immediately <br /> <br />communicated <br /> <br />to <br /> <br />Engineer <br /> <br />if <br /> <br />the <br /> <br />Engineer <br /> <br />was <br /> <br />unavailable at the time of issuance of instructions. <br /> <br />1.3.6 <br /> <br />The Engineer shall attend a pre-construction conference with <br /> <br />the <br /> <br /> Contractor and members of Owner's staff and shall make <br />professional on-site observations of the project often enough to <br />ensure familiarity with the progress and quality of the Work, to <br /> <br />determine <br /> <br />if the Work is proceeding in acceptable conformance with the <br /> <br />construction <br /> <br />contract <br /> <br />documents, <br /> <br />and <br /> <br />to <br /> <br />review <br /> <br />the <br /> <br />work with the <br /> <br />Owner's <br /> <br />inspector. <br /> <br />However, <br /> <br />such on-site observations shall not be <br /> <br />less <br /> <br />than <br /> <br />four <br /> <br />( 4 ) <br /> <br />per <br /> <br />month. <br /> <br />On <br /> <br />the <br /> <br />basis <br /> <br />of <br /> <br />such <br /> <br />on-site <br /> <br />professional <br /> <br />observations <br /> <br />as an engineer, the Engineer shall keep the <br /> <br />Owner <br /> <br />informed of the progress and quality of the Work. <br /> <br />In performing <br /> <br />these <br /> <br />services, <br /> <br />the <br /> <br />Engineer <br /> <br />will <br /> <br />endeavor <br /> <br />to <br /> <br />protect <br /> <br />the Owner <br /> <br />against <br /> <br />defects <br /> <br />and <br /> <br />deficiencies <br /> <br />in the quality and quantity of the <br /> <br />Work <br /> <br />of <br /> <br />the Contractor if such are within the Engineer's knowledge or <br /> <br />should reasonably have been within the knowledge of the Engineer. <br /> <br />-5- <br />
