<br />G. <br /> <br />04)1'1 <br />V!:' .; <br /> <br />Ot'lr1 <br />(} .:i <br /> <br />-9- <br /> <br />sixty (60) days of its receipt of a written statement from <br /> <br />the <br /> <br />City which <br /> <br />itemizes <br /> <br />these <br /> <br />fees <br /> <br />and <br /> <br />incorporates <br /> <br />any <br /> <br />reductions as provided above. <br /> <br />VF further agrees that, should <br /> <br />it fail to remit full payment of this amount within that <br /> <br />time, then the City is expressly authorized to have a copy of <br /> <br />the itemized statement executed by the City Manager of the <br /> <br />Ci ty recorded in the real property records of Hays County, <br /> <br />Texas, as a lien against the Property. <br /> <br />Provided, that in the <br /> <br />event <br /> <br />of <br /> <br />VF <br /> <br />bona <br /> <br />fide <br /> <br />dispute <br /> <br />between <br /> <br />the <br /> <br />City <br /> <br />and <br /> <br />a <br /> <br />regarding default, if VF deposits with the City a bond in the <br /> <br />amount of, <br /> <br />or other reasonable security for, the fees due <br /> <br />pursuant to this Section V(F), the City shall not record a <br />lien against the Property to secure the payment of such fees. <br /> <br />VF expressly acknowledges and agrees that the amount of taxes <br /> <br />abated each year under the terms of this Agreement shall be <br /> <br />secured by a first and prior tax lien on the Property which <br /> <br />shall continue in existence from year to year until such time <br /> <br />as <br /> <br />this Agreement <br /> <br />all <br /> <br />is <br /> <br />fully performed by VF or until <br /> <br />abated taxes, <br /> <br />whether assessed or recaptured, <br /> <br />are paid in <br /> <br />full. <br /> <br />H. <br /> <br />The remedies set forth in Sections V(A) through (E) are the <br /> <br />exclusive <br /> <br />remedies <br /> <br />for <br /> <br />the <br /> <br />defaults <br /> <br />forth <br /> <br />in <br /> <br />those <br /> <br />set <br /> <br />sections and are cumulative. <br /> <br />Unless the City gives written <br /> <br />notice <br /> <br />to VF of <br /> <br />a breach of, <br /> <br />failure to <br /> <br />comply with or <br /> <br />default <br /> <br />in the performance of <br /> <br />its <br /> <br />obligations under this <br /> <br />Agreement prior to March 1 of the year following the year in <br /> <br />which such breach, failure or default is alleged to occur, <br />
