<br />A. <br /> <br />-10- <br /> <br />OFf <br />'.' ,I <br /> <br />n <br />,j <br /> <br />0 <br />C <br /> <br />the City shall have waived all such breaches, <br /> <br />failures and <br /> <br />defaults for such year. <br /> <br />I. <br /> <br />Notwi thstanding anything to the contrary contained in this <br /> <br />Agreement, the liability of VF under this Agreement shall not <br /> <br />exceed the amount of the Tax Abatement actually received by <br /> <br />VF pursuant to the terms of this Agreement. <br /> <br />VI. <br /> <br />ECONOMIC INCENTIVES PROVIDED BY THE CITY <br /> <br />The City agrees to annex the property described in Exhibit A <br /> <br />as <br /> <br />possible, <br /> <br />to <br /> <br />exercising <br /> <br />reasonable <br /> <br />soon <br /> <br />diligence <br /> <br />as <br /> <br />accomplish the same. <br /> <br />However, in no event shall the City <br /> <br />fail <br /> <br />complete <br /> <br />the <br /> <br />to <br /> <br />annexation <br /> <br />of <br /> <br />the <br /> <br />property <br /> <br />before <br /> <br />December 31, 1990. <br /> <br />Completion of the annexation shall mean <br /> <br />the adoption of an annexation ordinance with respect to the <br /> <br />subject property. <br /> <br />B. <br /> <br />The <br /> <br />and <br /> <br />City <br /> <br />provide <br /> <br />to <br /> <br />the <br /> <br />following <br /> <br />incentives <br /> <br />agrees <br /> <br />benefits to VF: <br /> <br />( 1) <br /> <br />The City agrees to waive all fees (the "Fee Waivers") <br /> <br />associated with zoning, the subdivision process, utility <br /> <br />connections, <br /> <br />and building inspections <br /> <br />associated with <br /> <br />the construction of the improvements listed in Section <br /> <br />II (A) , <br /> <br />including, <br /> <br />fees, <br /> <br />without <br /> <br />limitation, <br /> <br />permit <br /> <br />signage <br /> <br />fees <br /> <br />and <br /> <br />all <br /> <br />other <br /> <br />development <br /> <br />fees. <br /> <br />Notwithstanding the previous sentence, <br /> <br />the Ci ty shall <br /> <br />not waive any capital recovery fees with respect to the <br /> <br />sanitary sewer facility to be constructed in connection <br /> <br />with the improvements to the Property. <br />
