(3 ) (4) (5 ) (6 ) -3- one hundred twenty (120) days prior to the beginning of the fiscal year, a list of recommended changes, if any, in the master plan; Review all plans for platting and subdividing of land within the city and within adjacent areas as permitted by law; Hold a public hearing at least once each three (3) years to review the subdivision ordinance; Submit annually to the city council not less than one hundred twenty (120) days prior to the beginning of the fiscal year, a list of recommended capital improvements found necessary or desirable; and Request, respond and receive from the zoning commission any recommendations or determinations on any proposal. MEASURE NO. FIVE SHALL SUBSECTIONS (a) and (c) ( 1) OF SECTION 12.02 OF THE CITY CHARTER BE AMENDED TO READ AS FOLLOWS: (a) (c) ( 1 ) All elected and appointed officers of the city shall comply with applicable requirements of State law pertaining to conflicts of interest of local government officials. (2 ) A person is ineligible for election or appointment to a position as an officer of the city if the person has an ownership interest in a business enti ty that has a contract or contracts for the sale to the city of any land, materials, supplies or service in an amount of $7,500 or more annually; provided that city council members shall be subject to paragraph (3) below. Any city officer, other than a city council member, who becomes ineligible under this provision while in office shall forfeit the office held. Any violation of these provisions shall render any contract entered into between the city and the business entity during the period of the violation voidable by the city manager or the city council. ( 3) No member of the city council, and no employee of the city shall have a financial interest in the sale to the city of any land, materials, supplies or service, outside of the person's position with the city. Any person having such an interest shall be ineligible for election as a city council member or appointment as an employee of the city, and any city council member or employee who acquires such an interest shall forfeit the office or employment. Any violation of this provision with the actual or constructive knowledge of the city council member or employee shall render the contract voidable by the city manager or the city council. (4 ) These provisions shall not apply to acquisitions of property by the city as a result of eminent domain proceedings or the threat of eminent domain proceedings. (1) The ethics review commission shall meet at least once a year to review the code of ethics of the City of San Marcos and make recommendations, if any, to the city council.
