<br />(3 ) <br /> <br />(4) <br /> <br />(5 ) <br /> <br />(6 ) <br /> <br />-3- <br /> <br />one hundred twenty (120) days prior to the beginning of <br />the fiscal year, a list of recommended changes, if any, <br />in the master plan; <br /> <br />Review all plans for platting and subdividing of land <br />within the city and within adjacent areas as permitted <br />by law; <br /> <br />Hold a public hearing at least once each three (3) years <br />to review the subdivision ordinance; <br /> <br />Submit annually to the city council not less than one <br />hundred twenty (120) days prior to the beginning of the <br />fiscal year, a list of recommended capital improvements <br />found necessary or desirable; and <br /> <br />Request, respond and receive from the zoning commission <br />any recommendations or determinations on any proposal. <br /> <br />MEASURE NO. FIVE <br />SHALL SUBSECTIONS (a) and (c) ( 1) OF SECTION 12.02 OF THE <br />CITY CHARTER BE AMENDED TO READ AS FOLLOWS: <br /> <br />(a) <br /> <br />(c) <br /> <br />( 1 ) <br /> <br />All elected and appointed officers of the city <br />shall comply with applicable requirements of State <br />law pertaining to conflicts of interest of local <br />government officials. <br /> <br />(2 ) <br /> <br />A person is ineligible for election or appointment <br />to a position as an officer of the city if the <br />person has an ownership interest in a business <br />enti ty that has a contract or contracts for the <br />sale to the city of any land, materials, supplies <br />or service in an amount of $7,500 or more annually; <br />provided that city council members shall be subject <br />to paragraph (3) below. Any city officer, other <br />than a city council member, who becomes ineligible <br />under this provision while in office shall <br />forfeit the office held. Any violation of these <br />provisions shall render any contract entered into <br />between the city and the business entity during the <br />period of the violation voidable by the city <br />manager or the city council. <br /> <br />( 3) <br /> <br />No member of the city council, and no employee of <br />the city shall have a financial interest in the <br />sale to the city of any land, materials, supplies <br />or service, outside of the person's position with <br />the city. Any person having such an interest shall <br />be ineligible for election as a city council member <br />or appointment as an employee of the city, and any <br />city council member or employee who acquires such <br />an interest shall forfeit the office or <br />employment. Any violation of this provision with <br />the actual or constructive knowledge of the city <br />council member or employee shall render the <br />contract voidable by the city manager or the city <br />council. <br /> <br />(4 ) <br /> <br />These provisions shall not apply to acquisitions of <br />property by the city as a result of eminent domain <br />proceedings or the threat of eminent domain <br />proceedings. <br /> <br />(1) <br /> <br />The ethics review commission shall meet at least <br />once a year to review the code of ethics of the <br />City of San Marcos and make recommendations, if <br />any, to the city council. <br />
