<br />-4- <br /> <br />MEASURE NO, SIX <br />SHALL THE CITY COUNCIL BE AUTHORIZED TO LEASE THE STORAGE AND <br />BATHROOM PORTIONS OF THE RECREATION BUILDING IN THE SAN <br />MARCOS CITY PARK, TOGETHER WITH ACCESS THROUGH THE ADJACENT <br />PARKING LOT, TO THE SAN MARCOS LIONS CLUB FOR THE PURPOSE OF <br />CONDUCTING AN INNER TUBE RENTAL OPERATION, SUBJECT TO THE <br />FOLLOWING TERMS AND CONDITIONS: <br /> <br />( 1 ) <br /> <br />(2 ) <br /> <br />( 3 ) <br /> <br />(4 ) <br /> <br />(5 ) <br /> <br />(6 ) <br /> <br />(7 ) <br /> <br />( 8 ) <br /> <br />( 9 ) <br /> <br />The Lions Club shall have possession of the Leased <br />Premises and access through the parking lot adjacent to <br />the leased premises, for the purpose of conducting an <br />inner tube rental operation on the San Marcos Hi ver, <br />from April 11, 1991, through April 10, 1996, together <br />with three (3) consecutive five (5) year renewable <br />options to continue this lease in favor of the Club, to <br />commence, if exercised, on April 11, 1996, April 11, <br />2001, and April 11,2006, respectively. The exercise of <br />each of such options shall be subject to the approval of <br />the City Council. <br /> <br />The Lions Club shall maintain the Leased Premises as <br />four (4) storage rooms (one of which shall be usable for <br />storage by the City Parks and Recreation Department as <br />needed) and two bathrooms. <br /> <br />The Lions Club shall paint the exterior of the Leased <br />Premises every two (2) years, and shall paint the <br />interior of the storage portions of the building every <br />fifth (5th) year, and shall paint the bathrooms every <br />year. In the event the City paints the exterior of the <br />remaining portions of the recreation building more often <br />than every two (2) years, the Lions Club shall paint the <br />exterior of its portions of the building at least as <br />often as the City. <br /> <br />The Lions Club shall pay all lighting and hearing costs <br />attributable to the Leased Premises, <br /> <br />The Lions Club shall keep the Leased Premises in a clean <br />condition, shall provide assistance to the City in the <br />regular cleaning of the area adjacent to the recreation <br />building, including the picnic area and parking lot, and <br />will also assist in the cleanup of the San Marcos River <br />in and around the park area. <br /> <br />The City shall continue to maintain those areas of City <br />Park not specifically granted to the Lions Club for its <br />sole or joint maintenance. <br /> <br />The Lions Club shall assist the City in future projects <br />within the City's park system. <br /> <br />The Lions Club shall have the right to sell items <br />related to the inner tube rental operation and to the <br />City, including chips, candy, non-alcoholic beverages <br />and T-shirts. <br /> <br />The Lions Club shall maintain public liability insurance <br />(: -vering personal injuries and property damage that may <br />occur in connection with the inner tube rental <br />operation. <br /> <br />(10) The Lions Club shall not discriminate in its inner tube <br />rental operations on the basis of race, creed, national <br />origin or ancestry, sex, or handicap. <br /> <br />SECTION 3, That the ballots for the election called <br />hereunder shall conform to the requirements of the Texas Election <br />Code, and shall have the measures described herein stated as <br />propositions on such ballots as follows: <br /> <br />Proposition No.1 <br />
