<br /> l15 <br /> Regular Meeting September 12, 1983 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br /> WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br /> OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br /> 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 26.468 <br /> ACRES OUT OF THE E. CLARK SURVEY #11, AND THE R. H. <br /> WILLIAMS SURVEY #12, HAYS COUNTY, TEXAS, LOCATED ON <br /> BISHOP APPROXIMATELY 300 FEET SOUTH OF RANCH ROAD 12, <br /> FROM "R-l" (SINGLE-FAMILY DWELLING DISTRICT) TO "PUD" <br /> (PLANNED UNIT DEVELOPMENT DISTRICT). <br /> Mayor Craddock opened the public hearing and asked if anyone wished <br /> to speak in favor of the zoning change. Patrick Miller, the developer <br /> of the property, reviewed his PUD development plans with the Council, <br /> Phase 1 to be patio homes. The development will have a park area which <br /> will be included in the grounds maintenance. The PUD development re- <br /> quires the formation of a homeowners' association after 50% of the <br /> property is sold. Joe Garza said PUD gives the developer more flexi- <br /> bility for more creative type development. The Planning Commission <br /> has the power to approve the lot sizes, and that minimum standards <br /> can be varied but not the density. John Schwarzcwalder, an adjacent <br /> property owner, said he was in favor of the project and thought it <br /> would enhance the neighborhood. Mayor Craddock asked if anyone else <br /> wished to speak in favor and no one did. She asked if anyone wished <br /> to oppose the change. Dr. Ken Long said he did not oppose this pro- <br /> ject but that the City's process was backwards, approving the zoning <br /> prior to the plans. No one else wished to speak in favor or in opposi- <br /> tion to the zonlng request, so Mayor Craddock closed the public hear- <br /> ing. Mr. Farr moved to approve the Ordinance on first reading and Ms. <br /> Kissler seconded the motion, which passed unanimously. <br /> Mayor Craddock introduced for consideration the adoption of an Ordin- <br /> ance on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, SETTING FORTH AN ITEMIZED ESTIMATE OF <br /> THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE UNIT OF <br /> THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE FISCAL <br /> YEAR BEGINNING ON OCTOBER 1, 1983 AND ENDING ON SEPTEM- <br /> BER 30, 1984, AND APPROPRIATING MONEY FOR THE VARIOUS <br /> FUNDS AND PURPOSES OF SUCH ESTIMATE; APPROPRIATING <br /> MONEY TO PAY INTEREST AND PRINCIPAL SINKING FUND RE- <br /> QUIREMENTS ON ALL INDEBTEDNESS; APPROPRIATING FUNDS <br /> FROM REVENUE SHARING ENTITLEMENT NO. 15; PROVIDING <br /> A SAVINGS CLAUSE FOR THE REPEAL OF ALL ORDINANCES AND <br /> APPROPRIATIONS IN CONFLICT WITH THE PROVISIONS OF <br /> THIS ORDINANCE AND DECLARING AN EMERGENCY. <br /> Mr. Guerra moved for the adoption of the Ordinance and Ms. Kissler <br /> seconded the motion. Henry Kyle stated the City was not following <br /> the Charter regarding the adoption of the budget. Ken Long stated <br /> the Council hurried through their budget process without consideration <br /> of what the public wants and that we need to change the Charter to <br /> allow more public hearings earlier in the process. On roll call the <br /> following vote was recorded: <br /> AYE: Brown, Farr, Guerra, Craddock, Kissler. <br /> NAY: Kreczmer, Moore. <br /> ABSTAIN: None. <br />
