<br /> Construction Contract documents, the engineer and FAA's <br /> representatives shall inspect the construction site. Within seven <br /> days of such inspection, the engineer shall furnish the FAA with a <br /> brief written report identifying items which appear to require <br /> repair or replacement as provided under the guarantee and warranty <br /> provisions of the contract. However, the engineer shall not be <br /> held responsible for discovery of hidden defects or to perform <br /> testing in order to confirm or establish technical reasons for <br /> deficiencies, or to undertake studies or analyses to mitigate any <br /> apparent problems. <br /> ARTICLE 5 <br /> COMPENSATION <br /> 5.1 PAYMENT FOR BASIC SERVICES, PHASES 1 AND 2 <br /> 5.1.1 Payment for services under Phases 1,2, and 3 shall be <br /> a total sum of $82,519.00. The following allocation of the charge <br /> shall apply: <br /> Phase 1 - Preliminary Design - 35 Percent $28,188.00 <br /> Phase 2 - Final Design - 45 Percent $36,263.00 <br /> Phase 3. - General Adminis- <br /> tration of <br /> Construction - 20 Percent $18,068.00 <br /> 5.1.2 Payment shall be made to the CONSULTANT during Phase 1 <br /> and Phase 2 within thirty (30) days of presentation of statements <br /> for such services to the OWNER. In no case shall partial <br /> payments be in excess of the value of the services completed at <br /> the time a statement is rendered. <br /> 5.2 PAYMENT FOR BASIC SERVICES, PHASES 3 AND 4 <br /> 5.2.1 Payment for Phase 3 services will be made to the <br /> CONSULTANT on a monthly basis, in direct proportion to the <br /> Contractor's earnings. The CONSULTANT will submit a statement <br /> each month for this Payment. Payments shall be due to CONSULTANT <br /> within thirty (30) days from presentation of statement. The OWNER <br /> shall withhold $1,000.00 of CONSULTANT's final statement for Phase <br /> 3 services pending FAA receipt and approval of all as-built and <br /> record drawings. Upon OWNER's receipt of FAA approval, this <br /> withheld amount shall be paid to CONSULTANT. <br /> 5.2.2 Payment for Phase 4 services shall be made to the <br /> CONSULTANT on the basis of the number of hours of resident <br /> construction inspection services, at the hourly rate of $39.00. <br /> Total payments for Phase 4 services shall not exceed the sum of <br /> $51,480.00. CONSULTANT will present itemized monthly statements <br /> for these services to OWNER, and OWNER shall make payments within <br /> thirty (30) days of presentation of statements. <br /> -10- <br />
