<br /> 21 <br /> Regular Meeting October 24, 1983 Page 3 <br /> Mr. Brown asked if anyone wished to speak in favor of the zoning <br /> request. Jim Byrn stated he was representing the owner, Mr. Dobie. <br /> There was a discussion about the need for right-of-way to address <br /> some of the traffic concerns and a need for a main lift station in <br /> this area. Joe Dobie stated he had no immediate plans for the de- <br /> velopment of this property once it is zoned. He states his plans <br /> are to provide zoning for approximately 114 trailers. He stated he <br /> was in agreement to give a 70 foot right-of-way easement. City <br /> Manager Gonzalez stated the Staff was following the Council's ex- <br /> tension policy. No one else wished to speak in favor of the zoning <br /> request, so Mr. Brown asked if anyone wished to speak in opposition. <br /> Gayle Ross stated there is a utility problem in the area and should <br /> the City continue to add to the water/wastewater when it is now limit- <br /> ed. Dr. Ken Long asked George Boeker about his concerns regarding <br /> our sewer treatment plant. City Manager Gonzalez stated zoning is <br /> not a problem. Building permits and platting would be required be- <br /> fore development could proceed. City Planner Joe Garza said a por- <br /> tion of the property is in the flood plain and a portion in the flood- <br /> way. He said some of the area could be developed in the flood plain, <br /> which would require the mobile homes to be elevated. No one else <br /> wished to speak in favor or in opposition to the request, so Mr. <br /> Brown closed the public hearing. Mr. Kreczmer moved to approve the <br /> Ordinance on first reading and Mr. Farr seconded the motion, which <br /> passed unanimously. <br /> Mr. Brown opened a public hearing to consider approval of a Zoning <br /> Ordinance on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br /> WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br /> OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, <br /> 1980 (VOL. 54) BY ZONING 4.8 ACRES, MORE OR LESS, OF <br /> LAND AREA IN THE J. M. VERAMENDI LEAGUE NO. 2 IN SAN <br /> MARCOS, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT <br /> 45.1 ACRE TRACT OF LAND DESCRIBED IN A DEED FROM THEO <br /> SCHAWE, ET UX, TO LEWIS DOBIE, ET UX, DATED DECEMBER <br /> 15, 1953, AND RECORDED IN VOLUME 158, PAGE 80 OF THE <br /> HAYS COUNTY DEED RECORDS, LOCATED IN THE 1100 BLOCK <br /> OF UHLAND ROAD, FROM "AO" (AGRICULTURAL-OPEN SPACE <br /> DISTRICT) TO "MH" (MOBILE HOME DISTRICT). <br /> Mr. Brown opened the public hearing and asked if anyone wished to <br /> speak in favor of the zoning request. Jim Byrn stated he was there <br /> to answer any questions of the Council. No one wished to speak in <br /> favor or in opposition to the request, so Mr. Brown closed the public <br /> hearing.
