<br /> 3 <br /> 36. <br /> 2. That LESSEE accepts the leased premises "as is" and in <br /> their present condi tion, hidden or otherwise unknown <br /> defects or dangerous conditions excepted. <br /> 3. That LESSEE shall pay for all repairs to the leased <br /> premises made necessary by its negligent acts. LESSEE <br /> shall further arrange and pay for one (1) service call <br /> (preventive maintenance) during the primary lease term <br /> for the air conditioning system and shall be responsible <br /> for the regular changing of filters for the air <br /> conditioning and heating systems and equipment. <br /> 4. That LESSEE will pay all utilities in connection with the <br /> leased space. utilities other than telephone service <br /> shall remain in LESSOR's name, and LESSOR will furnish <br /> LESSEE a copy of monthly utility use statements from <br /> Entex Gas and New Braunfels Electric utilities within <br /> five (5) days of LESSOR's receipt of said monthly bills. <br /> LESSEE agrees to reimburse LESSOR in full for such <br /> utilities on or before the 15th day of each month. As <br /> a portion of the building is currently leased to another <br /> tenant, and electricity for these leased premises and the <br /> premises leased by another tenant will not be separately <br /> metered, LESSOR and LESSEE do hereby agree that the sum <br /> of $13.00 per month shall be deducted from LESSEE's total <br /> electrical bill, such amount being the agreed estimated <br /> monthly cost of the electricity usage by the other <br /> tenant. Should the tenancy of such other portion of the <br /> building not leased by LESSEE change, the foregoing <br /> provision pertaining to charges for electricity shall be <br /> amended to reflect an equitable adjustment of such <br /> charge. If the commencement date of the term of this <br /> lease shall be other than the first day of the calendar <br /> month, the cost of utilities for such partial month shall <br /> be calculated and prorated on the basis of a 3 O-day <br /> calendar month. <br /> 5. That LESSEE shall pay for any and all changes in interior <br /> decoration such as draperies, painting and carpeting. <br /> 6. That LESSEE shall not (except as hereinafter stipulated) <br /> assign this lease agreement and/ or sublet the leased <br /> premises, or any part thereof, without in each instance <br /> obtaining the written permission of LESSOR; however, <br /> LESSOR's permission shall not be unreasonably withheld. <br /> LESSEE may, without LESSOR's permission, assign this <br /> lease and/ or sublet the leased premises, or any part <br /> thereof, to an affiliated, subsidiary, or reorganized <br /> corporation of LESSEE, for the purpose of continued <br /> operation hereunder of the business conducted on said <br />
