<br /> 10 <br /> animal, including a poisonous or otherwise dangerous <br /> reptile, unless licensed to do so by the Texas Parks and <br /> Wildlife Department for rehabilitation purposes. <br /> Sec. 3-47. Offerinq animals as Ðrizes: use of Ðoisons. <br /> <br /> (a) No person shall give away any animal, fish, reptile or <br /> bird as a prize for, or as an inducement to enter a place of <br /> amusement; or as an incentive to enter into any business <br /> agreement whereby the offer was made for the purpose of <br /> attracting trade. <br /> (b) No person shall expose any poisonous substance whether <br /> mixed with food or not, so that the same shall be liable to <br /> be eaten by any animal, provided that it shall be lawful for <br /> a person to expose on his own property common rat poison <br /> mixed only with vegetable substance. <br /> Sec. 3-48. Animal waste. <br /> (a) No owner or handler of any animal shall fail to <br /> promptly remove and dispose of in a sanitary manner, excreta <br /> deposited by the animal on any public property or private <br /> property including the property of the owner. <br /> (b) It shall be unlawful for any owner or handler of an <br /> animal to fail to keep the premises where the animal is <br /> kept, free from odors to the extent that the odors are <br /> disturbing to any person residing within reasonable <br /> proximity of the premises. <br /> (c) It shall be unlawful to allow animals or premises <br /> where animals are kept to b~come infested with fleas, ticks <br /> or other vermin, by failing to diligently and systematically <br /> apply accepted methods of insect and parasite control. <br /> Sec. 3-49. Duty of person strikinq animal. <br /> <br /> Any person who, as the operator of a motor vehicle, <br /> strikes any animal shall as soon as practicable report the <br /> occurrence to the city animal shelter or police department. <br /> Sec. 3-50. AdoÐtion proqram. <br /> <br /> (a) There is hereby established an animal adoption program <br /> for the city. All persons adopting animals from the City <br /> animal shelter shall agree prior to such adoption to have <br /> the animal spayed or neutered, and to obtain the required <br /> rabies vaccination. Upon payment of all adoption fees, a <br /> voucher will be issued which can be applied toward the cost <br /> of spaying/neutering and vaccinations. <br /> (b) The chief animal control officer shall promulgate <br /> rules and regulations pertaining to the operation of the <br /> animal control office's adoption program. These rules and <br /> regulations shall be made available to any person wishing to <br /> adopt any animal from the City animal shelter. <br /> (c) Fees for the adoption of animals from the city animal <br /> shelter shall be as set by separate ordinance by the city <br /> ccouncil. A schedule of such fees shall be kept on file for <br /> public inspection in the office of the city secretary and <br /> the animal control office. <br /> Sec. 3-51. Animals received by the animal shelter. <br /> <br /> (a) Any person who leaves an animal at the city animal <br /> shelter shall pay a drop-off fee as established by separate <br /> ordinance by the city council from time to time, copies of <br /> which shall be kept on file in the city secretary's office <br />
