<br /> 9 <br /> shall become the property of the San Marcos animal control <br /> department and shall be humanely euthanised or sold at <br /> public auction following the procedure as set forth herein. <br /> Sec. 3-43. Sale of imDounded livestock. <br /> All livestock impounded under this article that are not <br /> reclaimed by their owners wi thin three (3) working days <br /> after notice of impoundment is given to the owner, or within <br /> ten (10) working days of impoundment if the owner cannot be <br /> determined, may be sold by the chief of police at a public <br /> auction under the following conditions. <br /> (I) Notice of the time, location, and terms of sale, <br /> including a description of the animals to be sold, <br /> shall be given at least five (5) days in advance by <br /> posting such notice in at least two (2) public <br /> places in the city, and by publication of such <br /> notice at least once in a newspaper of general <br /> circulation within the city prior to the auction. <br /> (2) All sales shall be for cash. <br /> (3) A reasonable period of time shall be provided before <br /> all sales to allow public inspection of animals to <br /> be sold. <br /> An owner of impounded livestock may reclaim the livestock at <br /> any time before the sale of the livestock is announced at <br /> the auction by presentation of reasonable evidence of <br /> ownerhip and payment of all impoundment fees for the <br /> livestock. <br /> Sec. 3-44. Field euthanasia. <br /> If any animal found running at large in violation of this <br /> chapter cannot be safely impounded, the animal may, if it <br /> presents imminent danger to persons, property or other <br /> animals, be field euthanised by any authorized police or <br /> animal control officer. <br /> Sec. 3-45. KeeDinq of doas and cats: ~rohibition of hoas. <br /> <br /> (a) No person shall abandon a dog or cat upon moving out <br /> of residential premises occupied by the person. For <br /> purposes of this subsection, a dog or cat shall be deemed to <br /> be abandoned if it is left on the premises previously <br /> occupied by the person for a period of twenty-four (24) <br /> hours or more after public utilities serving the premises <br /> are disconnected. <br /> (b) No person shall keep a hog or allow the same to remain <br /> within the city. <br /> (c) Subsections (a) and (b) shall not apply to animal <br /> shelters, veterinary establishments, government agencies, or <br /> commercial animal establishments located on property zoned <br /> for such purposes. Such establishments, however, must meet <br /> sanitation requirements and keep all animals securely caged <br /> or penned. <br /> Sec. 3-46. KeeDina of wild animals. <br /> <br /> (a) No person shall own, possess, or have custody of any <br /> wild animal (including a reptile) for display, training, or <br /> exhibi tion purposes, whether gratuitously or for a fee. <br /> This section shall not apply to zoos, carnivals, or circuses <br /> licensed under the Texas Health and Safety Code. <br /> (b) No person shall keep or permit to be kept any wild <br />
