<br /> 8 <br /> Sec. 3-41. ImÐoundment of animals: <br /> <br /> (a) Dogs, cats, livestock, or fowl running at large and <br /> any animals otherwise in violation of the provisions of this <br /> Chapter, may be impounded in the city animal shelter. <br /> (b) Animals impounded under the provisions of this section <br /> shall be kept: <br /> (I) not less than five (5) working days for dogs and <br /> cats wearing valid city licenses unless earlier <br /> reclaimed by their owners under the conditions <br /> prescribed herein; <br /> (2) not less than three (3) working days for dogs <br /> and cats not wearing licenses as prescribed by <br /> this chapter, and livestock unless earlier <br /> reclaimed by their owners under the conditions <br /> prescribed herein; <br /> (3) one (I) hour to three (3) working days for wild <br /> animals at the discretion of the chief animal <br /> control officer or designee; or <br /> (4) Up to three (3) working days for sick or injured <br /> animals wearing no apparent identification <br /> through which ownership can be determined; at <br /> the discretion of the chief animal control <br /> officer or designee. <br /> (c) Any owner reclaiming ~n animal so impounded shall pay <br /> an impoundment fee, a boarding fee for each day of <br /> impoundment, and all costs of veterinary care incurred <br /> during the impoundment period. Fee amounts shall be set by <br /> the city council by separate ordinance from time to time. <br /> A schedule of these fees shall be kept on file for public <br /> inspection in the city secretary's office and at the city <br /> animal control shelter. These fees may be waived at the <br /> discretion of the chief animal control officer or designee, <br /> in unusual or extraordinary circumstances. <br /> (d) If an animal has been impounded by an animal control <br /> officer, no owner shall allow the animal to remain in the <br /> animal shelter beyond the time periods set in subsection (b) <br /> for the purpose of adopting the animal at a lower cost than <br /> the fines and/or fees that would Qtherwise apply to <br /> reclaiming the animal. <br /> (e) No sick, impounded animal shall be released to the <br /> owner until the chief animal control officer or designee is <br /> satisfied that arrangements have been made for the proper <br /> treatment of the sick animal. <br /> (f) In addition to, or in lieu of such impoundment, police <br /> or animal control officers may issue to the owner of an <br /> animal a notice of ordinance violation, which shall contain <br /> a written promise by the owner to appear in the municipal <br /> court of the city within ten (10) days of the date of the <br /> issuance to answer the charge made in the notice. <br /> Sec. 3-42. Disposition of unclaimed animals. <br /> <br /> Any healthy dog or cat left unclaimed after the expiration <br /> of the maximum time limit as provided in Section 3-41 of <br /> this article shall become the property of the City animal <br /> control department and shall be placed for adoption or <br /> humanely euthanised. All other impounded animals left <br /> unclaimed after the expiration of three (3) working days <br />
