<br /> 7 <br /> Sec. 3-31. Sale of livestock uoon oublic prooertv <br /> prohibited. <br /> <br /> (a) No person shall conduct a sale or auction of <br /> livestock, fowl or other animals upon any public property <br /> within the city limits. <br /> (b) No person shall conduct a sale or auction of <br /> livestock, fowl or any other animals that causes or induces <br /> other persons to assemble upon public property within the <br /> city. <br /> (c) This section shall not apply to sales under Section <br /> 3-43, or to judicial sales made by the officers of courts as <br /> ordered by such courts or prescribed by law, or to sales <br /> made upon the premises of the Hays County civic Center. <br /> Sec. 3-32. Drivinq or Herding of livestock. <br /> <br /> No person shall drive or herd any livestock upon any <br /> public property within the city except as provided for under <br /> state law. <br /> Sec. 3-33. Grazing of livestock uoon public prooerty. <br /> <br /> (a) No person shall permit livestock to graze upon any <br /> sidewalk, street, or other public property within the city. <br /> (b) Horses used by law enforcement agencies are exempted <br /> from this provision. <br /> Sec. 3-34. Pens and caqes to be kept clean and sanitary. <br /> (a) The pen or pens where any livestock are confined shall <br /> be kept in a clean and sanitary manner at all times and <br /> shall be subject to the inspection by the chief animal <br /> control officer or designee at all times between sunrise and <br /> sunset in order to determine compliance with the provisions <br /> of this section. <br /> (b) All fowl shall be confined in suitable sanitary pens <br /> or cages, which shall be subject to inspection by the chief <br /> animal control officer or designee at all times between <br /> sunrise and sunset in order to determine compliance with the <br /> provisions of this section. <br /> (c) The droppings and fecal matter from livestock and fowl <br /> shall be disposed of in a sanitary manner and shall not be <br /> placed in any garbage can or other container for removal by <br /> the city. <br /> Sec. 3-35 - 3-39. Reserved. <br /> ARTICLE V. CARE AND CONTROL OF ANIMALS <br /> Sec. 3-40. Restraint of dogs: public nuisance animals. <br /> <br /> (a) No owner or handler of a dog shall fail to keep such <br /> dog under restraint at all times. <br /> (b) No owner of an animal shall fail to exercise control <br /> over such animal to prevent it from becoming a public <br /> nuisance. <br /> (c) No owner of a dog or cat in heat shall fail to confine <br /> the animal in a building or secure enclosure that prevents <br /> any contact between the animal and any other animal except <br /> for planned breeding. <br />
