<br /> 6 <br /> (g) Any single place or facility to be used for more than <br /> one type of commercial animal establishment shall require a <br /> separate permit for each type of establishment. <br /> Sec. 3-22. Same-Fees as Drescribed. <br /> <br /> Fees for permits shall be as set by separate ordinance by <br /> the city council from time to time, copies of which are kept <br /> on file in the city secretary's office. A schedule of these <br /> fees shall be kept on file for public inspection in the <br /> office the city secretary and at the animal control shelter. <br /> Sec. 3-23. Same-Revocation. <br /> (a) Upon petition of the chief animal control officer or <br /> designee, the municipal court judge may, after a hearing, <br /> revoke a commercial animal establishment permit for the <br /> remainder of its current term upon any of the following <br /> grounds: <br /> (I) Withholding or falsifying information on an <br /> application for a permit; <br /> (2) Failure to comply with applicable provisions of <br /> this chapter, or with regulations promulgated <br /> pursuant to Section 3-24; <br /> (3) Conviction of the permit holder or of any <br /> employee of the permit holder's establishment, <br /> of a crime pertaining to the care and treatment <br /> of animals. <br /> (b) Any establishment whose permit is revoked shall <br /> humanely dispose of all animals owned or kept incident to <br /> the operation of the establishment within ten (10) days <br /> after such revocation. <br /> Sec. 3-24. Sanitation and humane reQuirements: offset from <br /> residences. <br /> (a) The chief animal control officer shall promulgate <br /> regulations pertaining to the care of animals at commercial <br /> animal establishments, including but not limited to, <br /> capacity, spacing, sanitation and feeding. A copy of these <br /> regulations shall be kept on file for public inspection in <br /> the office of the city secretary and the animal control <br /> department. The chief animal control officer or designee <br /> shall have the right of inspection at reasonable hours <br /> without notice for compliance with these regulations. <br /> (b) No commercial animal establishment, or part thereof, <br /> shall be located within one hundred (100) feet of any <br /> residence other than that of the owner or operator of the <br /> establishment; provided, this requiremènt shall not apply to <br /> commercial animal establishments in existence as of the <br /> effective date of the ordinance from which this section is <br /> derived; and provided further, that upon cessation of <br /> operation of such an existing establishment for a continuous <br /> period of sixty (60) or more days, the foregoing offset <br /> requirement shall thereupon apply to such establishment. <br /> Sec. 3-25 - 3-29. Reserved. <br /> ARTICLE IV. LIVESTOCK AND FOWL <br /> Sec. 3-30. Livestock and fowl not to run at larqe. <br /> <br /> No owner of livestock or fowl shall cause or permit any <br /> such animal to run at large upon any public property within <br /> the city, or upon private property other than that of the owner. <br />
