<br /> 2/7/85 AC 150/5100-14A <br /> CHAPTER 2. PROCEDURES FOR SELECTION OF CONSULTANTS <br /> 5. GENERAL. The two procedures included in this chapter are provided as a guide <br /> for sponsors in selecting consultants for work under Federal airport grant <br /> programs. Adherence to either of these procedures will assure a sponsor of <br /> compliance with the requirements of Attachment "0". Alternatively, sponsors may <br /> use guidelines I procedures developed by governmental agencies, private firms, <br /> industries, and professional societies and organizations or their own procurement <br /> regulations provided they reflect applicable state and local laws and regulations <br /> and so long as they do not conflict with the procurement standards for grant <br /> programs contained in the applicable Federal Aviation Regulations and Attachment <br /> "0" of OMB Circular A-102. <br /> a. Objective. <br /> (1) The selection of consultants shoulJ be made on the basis of fair <br /> negotiations and equitable fees and through selection procedures that are <br /> professionally acceptable, ensure maximum open and free competition, and avoid any <br /> suggestion of unfair or unethical conduct. <br /> (2) Consultants employed for work on projects involving airport grants <br /> should be responsible and possess the ability to perform successfully under the <br /> terms and conditions of the proposed procurement. Consideration should be given to <br /> such matters as integrity, record of past performance, extent of experience with <br /> the type of services required by the sponsor, technical resources, and <br /> accessibility to other necessary resources. <br /> b. Competitive Negotiation Procedures. Consultants should be engaged by means of <br /> competitive negotiation procedures that mayor may not include price as a selection <br /> factor. <br /> (1) In competitive negotiation procedures that do not include price as a <br /> factor, proposals are requested from a number of sources, the qualifications of <br /> consultants submitting proposals are evaluated, and the best qualified is selected, <br /> subject to negotiation of a fair and reasonable price. <br /> (2) In competitive negotiation procedures that include price as a <br /> factor, proposals are requested from a number of sources, oral presentations are <br /> made by consultants submitting offers, and a contract is awarded to the consultant <br /> whose proposal will be most advantageous to the sponsor in terms of the <br /> consultant's price, qualifications, and experience. The lowest price should not be <br /> the determining factor. <br /> c. Incidental Services. <br /> (1) Where incidental services are to be performed in conjunction with <br /> the architectural or engineering (AlE) services they should be contracted for in <br /> the course of procuring the AlE services. <br /> A1ctJc. 2 <br /> Chap 2 <br /> Par 5 5 <br />
