<br /> -2- <br /> b. LESSEE and LESSOR shall negotiate a new rental rate from <br /> October 1, 1990, to September 30, 1991, at least thirty (30) <br /> days prior to the termination of this contract. <br /> Any increase in the rental rate shall not be greater than <br /> the increase in the Consumer Price Index in effect from <br /> the effective date of this lease agreement to October 1, <br /> 1990. <br /> III. RENTAL <br /> The amount of rental for the leased premises payable by LESSEE to <br />LESSOR at 173 S. Seguin Street, New Braunfels, Texas, is the sum of <br />Three Hundred Sixty-Five Dollars ($365.00) per month, payable on the <br />first day of each and every month beginning June 1, 1989, and ending <br />with the rental payment due September 1, 1990. If the commencement <br />date of the term of this lease shall be other than the first day of <br />the calendar month, the rent for such partial month shall be calculated <br />and prorated on the basis of a thirty (30) day calendar month. <br /> IV. LESSEE'S COVENANTS <br /> LESSEE further covenants and agrees as follows: <br /> 1. That LESSEE will use the leased premises for the sole <br /> purpose of the performance of professional, administrative <br /> and clerical services by San Marcos, Texas, Women's, <br /> Infants' and Children's (WIC) Project No. 36. <br /> 2. That LESSEE accepts the leased premises "as is" and in their <br /> present condition, hidden or otherwise unknown defects or <br /> dangerous conditions excepted. <br /> 3. That LESSEE shall pay for all repairs to the leased premises <br /> made necessary by its negligent acts. LESSEE shall further <br /> arrange and pay for one (1) service call (preventive <br /> maintenance) during the primary lease te rm for the air <br /> conditioning system and shall be responsible for the regular <br /> changing of filters for the air conditioning and heating <br /> systems and equipment. <br /> 4. That LESSEE will pay all utilities in connection with the <br /> leased space. Utilities other than telephone service shall <br /> remain in LESSOR's name, and LESSOR will furnish LESSEE a <br /> copy of monthly utility use statements from Èntex Gas and <br /> New Braunfels Electric Utilities within five (5) days of <br /> LESSOR'S receipt of said monthly bills. LESSEE agrees to <br /> reimburse LESSOR in full for such utilities on or before the <br /> 15th day of each month. As a portion of the building is <br /> currently leased to another tenant, and electricity for <br /> these leased premises and the premises leased by another <br /> tenant will not be separately metered, LESSOR and LESSEE do <br /> hereby agree that the sum of $13.00 per month shall be <br /> deducted from LESSEE's total electrical bill, such amount <br /> being the agreed estimated monthly cost of the electricity <br /> usage by the other tenant. Should the tenancy of such other <br /> portion of the building not leased by LESSEE change, <br /> the foregoing provIsIon pertaining to charges for <br />
