<br /> 43 <br /> WATER PURCHASE CONTRACT <br /> This contract for the sale and purchase of water is entered <br />into as of the 10th day October 1989 between <br /> , , <br />Guadalupe-Blanco River Authority, a conservation and reclamation <br />district and political subdivision of the State of Texas (GBRA ) , <br />and the City of San Marcos, Hays County, Texas, ( S an Marcos), a <br />municipal corporation located in Hays and Caldwell Counties, <br />Texas. <br /> ItJITNESSETH <br /> RECITALS <br /> GBRA holds Certificate of Adjudication Number 18-2074-B (CA- <br />18-2074-B) issued by the Texas Water Commission, based on GBRA's <br />rights under Permit 1886, as amended. CA-18-2074-B authorizes <br />GBRA to impound water in Canyon Reservoir in Comal County, Texas, <br />and to divert and use therefrom not to exceed an average of <br />50,000 acre-feet of water per annum for domestic, municipal, and <br />industrial purposes and, temporarily, irrigation and recreation <br />purposes. <br /> San Marcos needs a firm surface water supply in order to <br />provide water for municipal and industrial purposes to its retail <br />customers within the service area of the City of San Marcos, and <br />desires to purchase from GBRA untreated water from storage in <br />Canyon Reservoir for such purposes. Th3 water will be treated at <br />a water treatment plant to be constructed in the vicinity of the <br />City of San Marcos, Hays County, Texas. <br /> 1 <br />
