<br /> At the present time, GBRA has available for sale from Canyon <br />Reservoir under CA-18-2074-B water for municipal use only, but <br />shall, upon request by San Marcos pursuant to this Contract, seek <br />the necessary authorizations from time to time from the Texas <br />Water Commission to allow a portion of such water to be used for <br />industrial use. <br /> AGREEMENT <br /> Now, therefore, for and in consideration of the mutual <br />promises, obligations, and benefits hereinafter set forth, GBRA <br />and San Marcos agree as follows: <br /> A. Quantity. GBRA shall furnish San Marcos, at the point <br /> <br />or points of delivery hereinafter specified, during the term of <br />this contract or any renewal or extension thereof, untreated <br />water released from conservation storage in Canyon Reservoir <br />under CA-18-2047-B, or other reservoir storage available to GBRA <br />in such quantity as may be required by San Marcos not to exceed <br />the Annual Commitment. The "Annual Commitment" shall mean the <br />minimum quantity of water to be taken from conservation storage <br />or paid for, whether taken or not, on an annual calendar-year <br />basis in any calendar year. The initial Annual Commitment shall <br />be 5,000 acre-feet of water per year, but may be increased from <br />storage in Canyon Reservoir, or other reservoir storage available <br />to GBRA, if available, pursuant to the following provisions: <br /> 1. If the total amount of stored water diverted in any <br /> calendar year exceeds the Annual Commitment <br /> applicable during that year, then, effective as of <br /> the first day of January of the following year, the <br /> 2 <br />
