<br />to allow a portion of the Annual Commitment applicable at such <br />time to be used for industrial use or, as the circumstances may <br />be, to convert a portion back to municipal use. Upon receipt of <br />any such request, GBRA shall seek the necessary authorizations <br />from the Texas Water Commission to allow an appropriate portion <br />of the Annual Commitment to be used for industrial use or, as the <br />circumstances may be, convert an appropriate portion back to <br />municipal use. San Marcos and GBRA contemplate that the uses of <br />stored water supplied under this Contract for "municipal use" and <br />"industrial use" will be within the definitions of such terms <br />under the Rules of the Texas Water Commission in existence on the <br />effective date of this Contract. These definitions, as found in <br />31 Tex. Adm. Code S 297.1, are set forth in Exhibit "C" attached <br />hereto. If the Commission or a court of competent jurisdiction <br />should ever determine that any of the uses of water presently <br />included wi thin such definitions are not either "municipal use" <br />or "industrial use" but, determine the use is within a purpose of <br />use other that "municipal use" or "industrial use", then, upon <br />request by San Marcos, GBRA shall seek the necessary <br />authorizations from the Commission to allow an appropriate <br />portion of the Annual Commitment applicable at such time to be <br />used for such other purpose of use. <br /> D. Place of Use. Any use of the stored water outside the <br /> <br />Guadalupe River Basin must be approved in advance in writing by <br />GBRA. <br /> E. Billing Procedure.
