2.3.2. Restrictive Covenants <br />The Developer shall prepare, submit for review by the City Legal Department, execute and record in the <br />official county records Conditions, Covenants and Restrictions for the Mixed Use Area and the Low <br />Density Residential Area before a building permit may be issued by the City in each Area of the District. <br />The Conditions, Covenants and Restrictions shall: <br />1. Create a Property Owners' Association with mandatory membership for each property owner; <br />2. Provide for the ownership, 'development,. management and maintenance of alleys and private open <br />space (except private open space owned by individual residential property Owners); <br />1. Be effective for a term of not less than fifty (50) years and be automatically renewable; and <br />2. Require that the Property Owners' Association obtain the written approval of the City. Director of <br />Planning or successor official (the "Director") for amendments to the Conditions, Covenants, and <br />Restrictions that relate to provisions required herein. <br />2.3.3. Property Owners Association <br />1 The Developer shall establish a Property Owners Association as part of the Conditions, Covenants <br />and Restrictions for the Property prior to the first building permit being issued by the City: <br />2. At the Developer's option, separate sub-associations may be created in different areas of the Project. <br />3. Each property owner in the Project shall be a member of the Property Owners' Association which <br />shall collect fees from each property owner for payment for the following common services: landscaping, <br />promotions and events, cleaning, security, marketing, architectural control and project administration. <br />4. If aproperty owner fails to timely pay its association fees, the Property Owners Association's <br />declaration of covenants shall enable it to file a lien against that owner's property. <br />2.3.4. Architectural Control Committee <br />1. The Developer must create an Architectural Control Committee as part of the Conditions, Covenants <br />and Restrictions for the Property, which shall be funded by the Property Owners Association. <br />2. The Developer or other person proposing the construction of a building must submit architectural <br />drawings including proposed size, elevations, percentage of masonry, and overall home design for <br />approval from the Architectural Control Committee. <br />3. All building exteriors, site plans and signage and environmental graphic designs must be approved by <br />the Architectural Control Committee prior to approval of a building permit by the City. The Developer or <br />other person proposing the construction of a building shall present a copy of.the written approval of the <br />Committee at the time of submission of a building permit application to the City. <br />2.3.5. Street Lights <br />The Developer may, with the written approval of the Director, incorporate alternative lighting standards <br />designed to aesthetically enhance the Property: <br />- 2.3.6. Fences and Gates <br />I <br />1. The maximum height of an Open Style Fence in a street yard shall be thirty-six (36) inches. Masonry <br />columns are permitted as part of all Open Style Fences. <br />5 <br />Blanco River Village PDD Development Standards
